Audio-only Telehealth Guidance Released by HHS

The U.S. Department of Health and Human Services (HHS) has released guidance for HIPAA-covered health professionals, providers, and health plans on using audio-only telehealth. In delivering this guidance, HHS noted that audio-only telehealth can "significantly expand access to health care" for some populations, including those with no or limited access to broadband or cellular coverage in their geographic area, individuals with disabilities, and individuals with limited English proficiency. The guidance describes when a covered provider or health plan does not need to have a business associate agreement in place with the vendor: when the telecommunication service provider is not creating, receiving, or maintaining protected health information.
